To all departments, public institutions and municipalities

 

المرجع: المرسوم رقم 11227 تاريخ 18/4/2023.

لما كانت المادة الثالثة من المرسوم رقم ١١٢٢٧ تاريخ ١٨/٤/٢٠٢٣ قد اشترطت للاستفادة من التعويض المؤقت موضوع المرسوم المذكور حضور الموظف أو الأجير أو المتعاقد أو العامل بأي صفة إلى مركز عمله، أربعة عشر يوماً شهريًا على الأقل ما لم يكن الغياب مبرراً قانوناً وعلى أن يعود لكل إدارة تنظيم الدوام بشكل يؤمن ديمومة وإستمرارية العمل في الإدارات الرسمية كل أيام الأسبوع،

   ولما كان التطبيق السليم لأحكام المادة المذكورة أعلاه يقضي بأن يعمد رئيس كل إدارة إلى وضع برنامج عمل شهري للعاملين التابعين له يحدِّد أيام الدوام المطلوبة من كل منهم وتنظيم المناوبة بما يضمن ديمومة واستمرارية العمل وفعاليته طيلة أيام الاسبوع،

    لذلك،

    يطلب إلى جميع الإدارات العامة والمؤسسات العامة والبلديات كل فيما خصها العمل على إعداد البرنامج المشار اليه إعلاه وإعطاؤه مجراه التنفيذي بالسرعة الممكنة وإيداع التفتيش المركزي نسخة عنه في خلال مهلة لا تتعدى الأسبوع من تاريخه على العنوان الإلكتروني التالي: //timeattendance@cib.gov.lb//وعلى أن يتم ايداع التفتيش المركزي لاحقًا وعلى العنوان إياه وفي نهاية كل شهر جدول الحضور المتعلق بتنفيذ البرنامج المشار اليه وذلك في سبيل تسهيل مهمة الرؤساء التسلسليين والتفتيش المركزي بضبط الدوام ومتابعة تنفيذ أحكام المرسوم المذكور أعلاه ووصول التعويض الموقت إلى مستحقيه ./.

To all departments, public institutions and municipalities

حيث أن القانون رقم 174/2011 تاريخ 29/8/2011 المتعلق بالحدّ من التدخين ، نص في المادة الخامسة منه على أن يحظر التدخين أو إشعال منتج تبغي أو استعمال مثل هكذا منتج في كل الأماكن العامة المغلقة وأماكن العمل ووسائل النقل العام ، كما نصت المادة السادسة منه على أنه يتوجب على كل إدارة مكان من الأماكن المذكورة في المادة الخامسة من هذا القانون وضع إشارات واضحة لمنع التدخين على مداخل هذه الأماكن وبداخلها ووسائل النقل ، وحيث تبين أن القانون يوجب على الإدارات والمؤسسات العامة والبلديات الإلتزام بتطبيق أحكامه والسهر على عدم مخالفته ، وحيث تبين أن معظم الإدارات لم تلتزم بتطبيق أحكام هذا القانون مما يؤثر على هيبة واحترام القوانين ضمن حرم الإدارة ، كما يتسبب بضرر مباشر على الصحة العامة وحرية وسلامة الموظفين والمواطنين على حدٍ سواء ، لذلـــــــك ، يطلب إلى جميع الإدارات والمؤسسات العامة والبلديات تطبيق أحكام القانون رقم 174/2011 وإتخاذ الإجراءات اللازمة حيال مخالفته المادة الخامسة عشر منه ووضع اللافتات والإشارات اللازمة على مداخل هذه الإدارات مع الإشارة إلى أن التفتيش المركزي سيواكب ما سيتخذ من هذه التدابير في حسن سير عمل الإدارة العامة
